Rental Agreement

This Rental Agreement (“Agreement”) is entered into between Mountain Tote LLC, a Colorado limited liability company (“Company”), and the customer agreeing to these terms (“Customer”).

 

1. RENTAL ITEMS

Company rents reusable moving totes, dollies, and related equipment (“Rental Items”), and sells moving supplies (“Consumables”).

Consumables (including but not limited to packing paper, zip ties, mattress bags, and wrap) are non-returnable and non-refundable.

 

2. RENTAL TERM

Standard rental period is one (1) week.

Rentals are charged per week, based on the selected duration.

Extensions must be requested before the scheduled pickup date and are subject to availability.

If Customer fails to request an extension and does not return items:

Rental will automatically continue

Customer will be charged for additional weekly periods until items are returned or deemed lost

 

3. DELIVERY & PICKUP

Company provides delivery and pickup only.

Customer agrees to be available during the scheduled delivery and pickup windows.

No-Show / Not Ready Policy: If Customer is not available or items are not ready.

A missed appointment fee will be charged

A new delivery or pickup must be scheduled at Customer’s expense

Delivery and pickup windows are estimates and may vary due to traffic, weather, or operational conditions.

 

4. PAYMENT TERMS & AUTHORIZATION

Full payment is due upfront at time of booking.

Customer expressly authorizes Company to charge the provided payment method for: Additional rental time, Late or extension fees, Missed appointment fees, Cleaning fees, Damage or replacement costs, Any other amounts owed under this Agreement

No additional approval is required for such charges.

 

5. USE OF RENTAL ITEMS

Customer agrees to: Use items only for normal moving and storage purposes

Not use items for: Hazardous materials, Liquids, Perishable goods, Living things

Customer may allow others to use the items but remains fully responsible for them at all times.

 

6. CONDITION, DAMAGE & CLEANING

Normal Wear Includes: Minor scuffs and surface scratches from typical use

Damage Includes (but is not limited to): Cracks, breaks, or structural damage, Missing components, Warping or melting, Strong odors or contamination, Tape, adhesive, residue, paint, or markings, Excessive dirt, debris, or improper contents 

Customer agrees to return items: Empty, Free of debris,In reasonably clean condition

Cleaning Fees: Standard cleaning is included. Heavy-duty cleaning fee: $15 per tote or dolly affected

 

7. LOSS, DAMAGE & REPLACEMENT COSTS

Customer is responsible for all Rental Items from delivery until pickup.

If items are lost, stolen, not returned, or damaged beyond normal wear, Customer agrees to pay the following replacement costs:

Medium Totes: $45 each

Large Totes: $65 each

Standard Dollies: $120 each

Foldable Dollies: $75 each

Molded Moving Dollies: $85 each

Furniture/Appliance Dollies: $65 each

Hydraulic Lift: $1,200

Company may charge replacement cost at its discretion based on condition.

 

8. NON-RETURN & MAXIMUM RENTAL PERIOD

If Rental Items are not returned and Company is unable to contact Customer or arrange pickup: Rental charges will continue weekly

After eight (8) weeks without communication, Company may: Deem items permanently lost, charge full replacement costs, Pursue collection if necessary

 

9. ACCESS, WEATHER & SITE CONDITIONS

Customer is responsible for ensuring safe and accessible delivery and pickup conditions.

This includes: Clear and safe walkways, Snow/ice removal, Adequate space for delivery

If conditions are unsafe or inaccessible, Company may: Delay service, Reschedule delivery or pickup, Charge additional fees

 

10. ACCESS RESTRICTIONS (APARTMENTS, GATED AREAS, ETC.)

Customer must ensure Company has all necessary access, including: Gate codes, Parking access, Elevator reservations, Loading dock access (if applicable)

Failure to provide access may result in delays and additional fees.

 

11. CONDITION DOCUMENTATION

Company may photograph or otherwise document Rental Items before delivery and after pickup.

These records may be used to determine condition and resolve disputes.

 

12. LIMITATION OF LIABILITY

Company is not responsible for: Damage to items stored inside totes, Improper packing by Customer, Loss or damage due to misuse

All Rental Items are used at Customer’s own risk.

 

13. CANCELLATIONS & REFUNDS

Cancellations must be made at least 48 hours in advance

Late cancellations may be subject to a fee

Refunds are issued in accordance with this policy

 

14. CHARGE DISPUTES

Customer agrees not to dispute valid charges that are consistent with this Agreement.

 

15. GOVERNING LAW

This Agreement shall be governed by the laws of the State of Colorado.

Any disputes shall be resolved in the appropriate courts serving the area of Company’s principal place of business in Colorado Springs.

 

16. COLLECTIONS & LEGAL FEES

If Customer fails to pay any amount owed:

Company may pursue collections

Customer agrees to pay all reasonable collection costs, including attorney’s fees

 

17. ENTIRE AGREEMENT

This Agreement represents the entire agreement between the parties and supersedes all prior communications.
